These Terms of Use ("Terms") constitute a legally binding agreement between you and Qcars ("we," "us," or "our") governing your access to and use of the Qcars mobile application and website (collectively, the "Services").

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws and regulations
• All registration information you submit is accurate and truthful

3. Account Registration and Security

3.1 Account Creation

To access certain features of our Services, you must create an account by providing:

• A valid email address
• A secure password
• Phone number (optional)

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that we believe have been compromised or are being used in violation of these Terms.

3.3 Account Information

You agree to provide accurate, current, and complete information and to update your information to maintain its accuracy. We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or misleading.

4. Subscription and Payment Terms

4.1 Subscription Plans

Qcars offers premium subscription plans that provide access to additional features and services. Subscription details, including pricing and features, are displayed within the app at the time of purchase.

4.2 Auto-Renewal

Subscriptions automatically renew at the end of each subscription period unless you cancel before the renewal date. You will be charged through your Apple ID account for the renewal.

4.3 Payment Processing

All subscription payments are processed through Apple's In-App Purchase system. Payment will be charged to your Apple ID account at confirmation of purchase. Your purchase is subject to Apple's Terms of Service and Privacy Policy.

4.4 Managing Subscriptions

You can manage and cancel your subscription at any time through your Apple ID account settings. To cancel:

• Go to Settings on your iOS device
• Tap your name, then tap Subscriptions
• Select the Qcars subscription
• Tap Cancel Subscription

4.5 Cancellation and Refunds

Cancellations must be made at least 24 hours before the end of the current subscription period to avoid being charged for the next period. Refunds are subject to Apple's refund policy. We do not provide refunds for unused portions of subscription periods.

4.6 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated to you in advance and will apply to subsequent subscription periods after your current period expires.

5. User Conduct and Responsibilities

5.1 Prohibited Activities

You agree not to:

• Post false, misleading, or fraudulent car listings
• Use the Services for any illegal purposes or to violate any laws
• Harass, abuse, or harm other users
• Post content that infringes on intellectual property rights
• Upload viruses, malware, or any harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scrapers) to access the Services
• Impersonate any person or entity
• Collect or store personal data about other users without permission
• Interfere with or disrupt the Services or servers

5.2 Content Posting

When posting car listings or other content, you agree to:

• Provide accurate and truthful information about vehicles
• Only post vehicles you have the legal right to sell or advertise
• Use appropriate and non-offensive language
• Not post duplicate or spam listings
• Upload only photos you own or have permission to use
• Include honest pricing and vehicle condition information

6. Intellectual Property Rights

6.1 Our Content

All content on the Services, including but not limited to text, graphics, logos, images, software, and design, is the property of Qcars or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services or included software without our express written permission.

6.2 User Content

You retain ownership of all content you post on our Services. By posting content, you grant Qcars a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute your content in connection with operating and promoting the Services.

You represent and warrant that you own or have the necessary rights to all content you post and that your content does not violate any third-party rights or applicable laws.

6.3 Content Removal

We reserve the right to remove any content that violates these Terms, infringes on intellectual property rights, or is otherwise objectionable at our sole discretion.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you consent to our collection and use of your information as described in the Privacy Policy.

9. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that:

• The Services will meet your requirements or expectations
• The Services will be uninterrupted, timely, secure, or error-free
• The information provided through the Services will be accurate or reliable
• Any vehicle listings are accurate, complete, or legally compliant
• Any transactions between users will be completed successfully

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QCARS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9.4 User Transactions

Qcars is a platform that connects buyers and sellers. We are not a party to any transactions between users. We do not guarantee the quality, safety, legality, or accuracy of any vehicle listings. Any disputes between users must be resolved directly between the parties involved.

10. Indemnification

You agree to indemnify, defend, and hold harmless Qcars, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or connected with your use of the Services or violation of these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at [email protected]. Termination does not entitle you to a refund of any subscription fees.

11.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that violates these Terms or harms other users.

11.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. We may delete your account and all associated content.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good faith negotiations or appropriate legal channels.
